Mejor respuesta: El legislador al redactar la ley le da un ALCANCE y éste no siempre cubre TODOS los temas a proteger, entonces cuando entra en vigencia y se estudia la ley a fondo, surgen naturalmente aquellos puntos que quedaron fuera del alcance de esa ley, ya sea por intención del legislador o por no haber sido prevista.
Por ende si hubo INTENCIONALIDAD del legislador, se dice que se hizo la ley y la trampa-
